After nearly 28 years, a special court from the Central Bank of Iraq issued its verdict in the case of the Babri mosque demolition on September 30, 2020. All 32 defendants have been acquitted. They are publicly expressing joy after the decision and distributing sweets. They congratulate each other. The atmosphere today was as it was on December 6, 1992, when the Babri Mosque in Ayodhya was demolished.
After the Babri Mosque was demolished, Hindu leaders gathered in Ayodhya and hugged each other and comforted them. The CBI court also considered audio, video, news and photos as evidence. In this way, all the accused were acquitted in the absence of evidence. It is now said that the Central Bank of Iraq failed to prove that the demolition of the Babri Mosque was a well-planned incident that these commanders orchestrated or instigated a mob in Ayodhya.
The question is: Who brought together the anarchist or anti-social elements in Ayodhya on which the elements of the Babri Mosque were destroyed? Did they come at the invitation of any person or organization, or did they come together spontaneously? No one called them?
Based on my experience joining the first Karseva as Karsevak, I can clearly say that everything was well planned. First, the atmosphere was created across the country. Rama rocks were worshiped. The cornerstone was laid, then the first Karseva of 1990, for which trained Karsevaks were taken from all over the country. Everyone had clear instructions that the Babri temple, the symbol of slavery, that stands as a stigma on Ram Janmabumi would be broken as soon as the opportunity arose. It was even said that tools such as an ax and shovel would be found in Ayodhya to break through the contested temple. No need to carry around with you.
At the time of Karseva I, there was a Samajwadi Party government led by Mulayam Singh in Uttar Pradesh. Karsivac couldn't stand his clever system and police sticks. Hence the Babri structure remained intact. Kalyan Singh of the BJP was in power during Karsiva II in November and December 1992. Somehow there was the Kar-Sivak government, so everything was done with complicity. On the one hand, the speeches of the leaders continued in Karsevakapuram and on the other hand the Karsevaks treasure ascended the domes of the Babri Mosque in a planned manner. The saffron flag was raised. Gagan's insightful slogans were chanted for Jay Shree Ram. Slogans such as "Pay one and two - Break the Babri Mosque", "Tilao Dabur Ka - Nam Karu Do Babar Ka" No opportunity was allowed for provocation by hand. All leaders and administrative and security forces helped Babri Mosque remove the rubble and create a temporary temple for the Ram Lala tent for idols to be recited in ... Now it is said that this was not a planned event.
If all this is done thoughtfully, even after the whole plan is implemented, then it is not considered well planned, then who should be told about the plot? The people who brought out the Rath Yatra prepared the people in whose presence the temple fell before their eyes and made no effective effort to stop it, but they expressed their happiness with this demolition, and they hastily congratulated them and committed this act openly. They get the credit, they all prove that they are innocent in the eyes of the law, so what could be a bigger tragedy than this?
The way our judicial system fails to deliver justice to an oppressed society is sad for democracy, as well as a threat to the future of this country. Just as the Supreme Court ruled in favor of the Ram Janmabumi Temple, respecting the sentiments of the majority community, even before the case for the demolition of the Babri Mosque was decided, on the same day, the ruling was also indicated that only the decision would be implemented. you did not.
As for the role of the Central Bank of Iraq, it is not a matter of separately saying that the central investigative agencies are playing their role as parrot. The way it has been used politically, is it expected to act against the desires of its superiors in power? Absolutely. Whether it is CBI or another investigative agency, they have already lost their credibility. They are now used more politically and are used to suppress, intimidate, or blackmail individuals with opposing views or political parties. Therefore, expecting him to punish the perpetrators of the Babri demolition is a futile exercise.
Now it must be like that about some judicial activity for the judiciary. Is our justice system really capable of delivering justice? Is it people oriented? Is it sensitive to those who suffer? The types of decisions that will be issued are only decisions, the element of justice disappearing from them, due to the loss of the judiciary’s trust among the deprived identities. The plaintiffs now treat this judicial process as a farce. This would shake the foundations of any constitutional democracy.
The way in which the Babri Mosque was demolished undermined hope for justice for the disadvantaged. People are now giving up hope for justice. They are starting to question the "promise of justice" mentioned in the preamble to the constitution, which is appalling. In the end it will lead to distrust of the constitution. It will draw people towards chaos rather than the rule of law, so that the loss is not compensated.
Now people are bluntly saying that the game of making victims guilty is going on. Also can be seen in the Bhima Koregaon case. Those who have been victims of violence are criminalized. More or less the same pattern can be seen in the police charge sheet relating to the recent sectarian riots in Delhi. This was happening at the base based on Manu Samhita, then came the rule of law, and established the rule of the constitution. But the Manwadi system is now determined to make disadvantaged groups of victims second-class citizens on the basis of Manu Smriti.
